Acceptable Use Policy

By using the High-Speed Internet Services provided by Truespeed Internet Services Inc. ("Truespeed") in Ontario, the Subscriber agrees to be bound by the terms and conditions of Truespeed's Acceptable Use Policy ("AUP"). If the Subscriber does not agree with the terms and conditions of this AUP, they must stop using Truespeed Services and notify Truespeed that services are to be cancelled immediately.
Truespeed is committed to making its High-Speed Internet Services a truly enjoyable and satisfying experience for all Subscribers. To protect the network and customers who could be affected through another user's abuse of these privileges, Truespeed has the right to terminate the Services of any person who contravenes the terms and conditions of this AUP.
Illegal Use
The Services may only be used for lawful purposes. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes material protected by copyright, trademark, trade secret or other intellectual property rights used without proper authorization, as well as material that is obscene, defamatory or constitutes a threat.
Truespeed does not authorize the use of its Services in any way that is contrary to law. Using the Services for the transmission or storage of copyright-protected material without the consent of the relevant rights holders may be an infringement of Canadian copyright law and could give rise to criminal and civil liability.
Security
Each Customer is responsible for ensuring that the use of the Services complies with this AUP. The Account Holder is fully responsible for any misuse of the Services even if the inappropriate activity was committed by another individual (such as a friend, family member, guest or employee) with access to the Subscriber's account.
Prohibited security-related activities include but are not limited to:
- Accessing data or systems without express authorization.
- Probing the security of other computers or networks.
- Forging any part of the TCP/IP packet header or email header information.
- Using tools designed for compromising security (e.g., password guessing programs, packet sniffers, network probing tools).
- Conducting denial-of-service attacks, network flooding, or attempting to crash a host.
- Transmitting software that contains a virus or other harmful feature.
Inappropriate Content
Truespeed does not assume responsibility for content available through its Services. The Customer must assume the risk of accessing content through the Services. Adults may want to use parental control software or devices if the Services are used by children.
The Customer is solely responsible for any information they publish online. Truespeed reserves the right to refuse to post or to remove any information or materials, in whole or in part, that is unlawful, offensive, or otherwise causes unnecessary stress on the Truespeed network.
Electronic Mail, Spam & Messaging
The Services may not be used to indiscriminately send unsolicited, unwanted, irrelevant or inappropriate messages in mass quantity (spam). Prohibited email activities include but are not limited to:
- Posting a single message or similar messages to more than nine online forums or newsgroups.
- Sending any unsolicited email regardless of whether it was sent via the Truespeed network.
- Forging, altering or removing electronic mail headers.
- Spoofing or using another user's identity or network address during chat sessions.
- Performing "flooding" activities — deliberately repeating actions to fill other users' screens with text.
- Using automated programs (e.g., "bots") when not physically present at the device.
By using Truespeed's servers, the Subscriber consents to anti-spam and anti-virus filtering by Truespeed.
IP Address Policy
Any IP address assigned by Truespeed is the property of Truespeed at all times. Subscribers are issued dynamically assigned IP addresses that may change at any time at Truespeed's discretion without prior notice.
Enforcement and Cooperation
Truespeed will determine appropriate action in response to a violation on a case-by-case basis. This may include cooperation with law enforcement, including providing a Customer's username, IP address or other information based on reasonable evidence and/or receipt of a warrant. Upon termination of Services, Truespeed is authorized to delete any files, programs, data and email messages associated with the Customer's account.
Violations of this AUP may also subject the account holder to criminal or civil liability. Questions and comments regarding this AUP should be directed to the Truespeed support department.
