VoIP Telephone Terms of Service

In an emergency, 9-1-1 operators will dispatch to your last registered address. To update your address, log in to your account or contact billing@truespeed.ca or call (613) 865-7733 option 3.
To retrieve or reset your 9-1-1 address passcode, visit: addressinfo.northern911.com/passcode.php — enter your phone number and the system will call you with an updated 5-digit passcode.
General Terms
The following terms apply to Truespeed's provision of telephony services ("Services"). All terms bind both Truespeed and the Subscriber and are subject to change at the sole discretion of Truespeed without prior notice.
The Subscriber agrees not to use the Service for any illegal purpose, to make annoying or offensive calls, or to interfere with other Subscribers' Service. Subscribers may not resell, transfer, or share services.
1. Emergency Services — 9-1-1 Dialing
1.01 — Important Differences from Traditional 9-1-1
Truespeed's TruePhone 9-1-1 dialing service differs from traditional Enhanced 9-1-1 (E9-1-1). With TruePhone, your call is sent to a national emergency call centre, which will confirm your location and transfer you to the nearest emergency response centre. You should be prepared to confirm your address and call-back number. Do not hang up unless told to do so; if disconnected, dial 9-1-1 again.
1.02 — Registration of Physical Location Required
You must ensure your location information registered with Truespeed is kept current at all times. You must update your 9-1-1 address if you move your device to a different location or add a new line to your account.
1.03 — Service Outages
9-1-1 dialing service will not function in the event of a power or broadband outage or if your broadband, ISP or home phone service is suspended or terminated.
1.04 — Network Congestion
There may be a greater possibility of network congestion and/or reduced speed in routing a 9-1-1 call via VoIP compared to traditional telephone networks.
1.05 — Inform All Household Residents
You must inform all household residents, guests and other persons at the location where Truespeed Home Phone service is used of the important differences and limitations of VoIP 9-1-1 dialing service.
1.06 — Disclaimer of Liability
Truespeed is not responsible for the conduct of emergency response centres and relies on third parties to assist in routing 9-1-1 calls. Neither Truespeed nor its officers or employees may be held liable for any claim, damage, or loss arising from or relating to the 9-1-1 dialing service unless such claims arise from gross negligence, recklessness or wilful misconduct.
2. Service
2.01 — Types of Services
These Terms apply to all telephony services Truespeed may provide, including unlimited calling plans, pay-per-use long distance plans, and TruePhone (Internet VoIP local phone service). Services may only be used by the Subscriber and persons having the Subscriber's permission. The Services may only be used for voice telephone calls to landlines — they cannot be used for internet connections, faxing, or other data transmission without a designated line.
2.02 — Charges, Billing and Payment
The Subscriber is responsible for paying all charges plus applicable taxes for all calls made via their telephones or using any number or authorization access code assigned to their account. NSF and refused payments incur an administrative fee per occurrence. Credit card chargebacks also incur an administrative fee. Truespeed reserves the right to charge an administration fee for all accounts remitted to collection, at which point 2% per month interest (24% per annum) will be applied to the outstanding balance.
3. Limitation of Liability
In no event shall Truespeed be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of or inability to use the VoIP telephone service, including but not limited to communication failures, service outages, or 9-1-1 routing issues, except where such damages arise from Truespeed's gross negligence or wilful misconduct.
4. Amendments
All Terms contained herein are subject to change at any time at the sole discretion of Truespeed without prior notice to the Subscriber. Continued use of the service after any changes constitutes acceptance of the revised terms.
